What is mediation?
Mediation is an "alternative dispute resolution" method commonly used in countries with advanced legal systems. Mediation is a method that parties can use to resolve their dispute with the help of a neutral third party, without going to court or through court referral.
Who is a mediator?
A mediator is a law school graduate with at least 5 years of experience who has passed the Mediation Exam conducted by the Ministry of Justice. The mediator is not the decision-maker, arbitrator, or judge in the process. The parties resolve the dispute by negotiating and reaching an agreement through their own free will.
Mediation Process
The mediator helps the parties explore and create various options to resolve the dispute. The parties evaluate the options created with the assistance of the mediator and their legal representatives. The parties engage in a bargaining process, which can be either distributive, integrative, or both.
Why should I apply to a mediator?
Mediation is one of the alternative dispute resolution methods. Through mediation, it is possible to resolve the dispute between the parties in a shorter time and with less expense compared to a lawsuit.
While the principle of publicity generally applies in court proceedings, the principle of confidentiality is fundamental in mediation.
In a court process, the judge makes the final decision, whereas in mediation, the parties decide how the dispute will be resolved.
